What is going on in this case?

We are learning about a lawsuit filed by a former Mattel employee that alleges he was falsely accused of “unnecessarily calling women over to his desk to justify his firing.”

He claims that the real reason he lost his job was due to the fact that he is 71 years old.

Benny Binshtock filed his lawsuit in the Los Angeles Superior Court, and the allegations against his former employer include:

According to the lawsuit, “Plaintiff believes that his age was a contributing factor in the decision of terminating his employment with the purpose of bringing younger employees into the plaintiff’s position.”

Binstock began working for Mattel in 1968.

The lawsuit claims that a round of layoffs in March 2018 made it clear that there was a pattern of terminating employees older in age. At the same time, Binstock was called into a meeting and told there was a sexual harassment complaint against him. He was terminated two months later.

Is this against the law?

Both state and federal law prohibit discrimination in the workplace. This includes discrimination against a person because of their:

  • Race or color
  • Ethnicity or nationality
  • Gender or sexual identity
  • Disability
  • Marital status
  • Religion (or lack of religion)
  • Age
  • And more

In many cases, discrimination is not outright. While this lawsuit against Mattel is in the early stages, we can see that one tactic used to discriminate is to make a termination seem legitimate.

  • Age-based discrimination in the workplace is real.

If a person can properly perform the duties of a job, they should not be discriminated against due to their age. There are specific federal protections in place to protect those over the age of 40 in the workplace.
